Medical Board action against Dr Jayant Patel

To ensure the ongoing protection of the public, the Medical Board of Australia and the Australian Health Practitioner Regulation Agency (AHPRA) today re-activated disciplinary action against Dr Jayant Patel.

The District Court in Queensland this morning confirmed Dr Patel’s conviction for fraud and sentenced him to two years jail, wholly suspended.

The Board and AHPRA have served Dr Patel with a referral notice alleging that:

  • Dr Patel provided false and misleading information in relation to his applications for registration (on two occasions) 
  • the clinical care provided to a number of patients was below the standard reasonably expected, and 
  • that Dr Patel’s conduct amounts to unsatisfactory professional conduct under the relevant law.

The referral recommences disciplinary action in the Queensland Civil and Administrative Tribunal (QCAT), which will hear the case against Dr Patel prosecuted by the Board.

The Board will seek orders from QCAT to prevent Dr Patel seeking registration as a medical practitioner in Australia. Dr Patel has not been registered or able to practise in Australia since April 2005.

The Tribunal will set a date for the hearing into Dr Patel’s professional conduct in due course.

To protect the integrity of ongoing legal processes, the Medical Board of Australia and AHPRA are not able to comment further.
